Booking Terms and Conditions
1. Your villa rental contract is with Joes Villas S.L. (“The Company”).
Any matter or issues arising from it shall be subject to English law and to the jurisdiction of the courts of England and Wales. If you are resident in Scotland or Northern Ireland, the courts of Scotland or Northern Ireland can deal with any disputes.
2. Deposits and Balances.
The lead person in the party, who makes the booking is responsible for all payments due. A 30% deposit is required at the time of booking your holiday. The balance of your holiday price must be paid 10 weeks prior to your departure. If the balance is not paid at the time due the lead person will become liable to have their holiday cancelled and cancellation charges levied.
3. The Company’s Responsibility.
The Company will apply the best means to provide your holiday in accordance with the booking. If it is obliged to do so for reasons beyond its control, the Company reserves the right to cancel any holiday. In this event the Company will do its best to provide comparable arrangements. If the Company is not able to do so, a full and immediate refund will be given and the Company shall be under no further liability.
4. Your Responsibilities
You are responsible for:
(a) Taking all reasonable care of the villa and its contents.
(b) Ensuring that the villa is left in a respectable condition so as not to require excessive cleaning on the Departure Date.
(c) Ensuring that consideration is given to the occupants of neighbouring properties and that no member of the party engages in any activity in the villa or around the swimming pool which may cause offence to neighbours or pollution to the water or damage to the structure or filtration equipment this includes but is not limited to unacceptable anti-social behaviour.
(d) Ensuring that all household rubbish is placed in the communal dustbins located nearby and ensuring that no person suffers anything to be done which would endanger the policy of our insurers in respect of the villa and its contents which might make the same invalid.
(e) If, in the opinion of ourselves, you appear to be behaving in such a way to cause danger or distress we may terminate your holiday arrangements forthwith and upon doing so we shall have no further liability to you and will not be responsible for any expenses you incur or be liable to make any refund or any compensation and
charge you any additional expenses we may incur as a result of your behaviour.
5. Cancellation.
If you have to cancel your holiday, you will be charged in accordance to the following scale.
Outside 70 days of departure date: Loss of deposit
Between 70 days and 50 days: 40% Charge
Between 49 days and 30 days: 60% Charge
Between 29 days and 20 days: 70% Charge
Between 19 days and 10 days: 80% Charge
Between 9 days and Departure date: 100% Charge
6. Debit and Credit card payments.
We do not apply any additional surcharges for payments made by credit or debit cards.
7. Data Protection Policy
In order to process your booking and to ensure that your travel arrangements run smoothly and meet your requirements we need to use the information you provide such as name, address, etc. We take full responsibility for ensuring that proper security measures are in place to protect your information. The information may also be provided to security or public authorities such as customs/immigration if required by them, or as required by law.
8. Complaints
Any complaints regarding the villa or its contents must be reported immediately to either us, and we will take all reasonable steps to resolve the matter. Should we be unable to resolve the matter during the period of hire then details of the complaint must be notified to us by email within 14 days from the Departure Date.
9. Passports
You are responsible for ensuring that you have the correct and up to date documentation.
10. Animals
Without exception we do not accept ANY pets at any of our properties at any time (guide dogs excepted).
11. Rights of Access
Representatives of the Company or their subcontractors have the right of access to the villa at any time with due regard to the convenience of the hirer for the purpose of Occupancy. The villa will be available for occupation from 3pm on the Commencement Date and must be vacated by 11.00am on the Departure Date.
12. A returnable bond of £150 is required at the time of booking. This is to cover any damages that may occur during your stay. On the understanding that no damages occur, this will be refunded to your card on your departure day. Please allow up to 5 working days for your card to be re-credited.
